The Personal Property Securities Act 2009 (Cth) (PPSA), which came into operation on 30 January 2012, has fundamentally changed the regime for taking security over personal property in Australia. The commencement of the PPSA left unprepared businesses in a flurry to update their processes. Many businesses have still not responded to the PPSA, or may not have realised the significant impact of the PPSA on their business. This became clear in July 2012 in the first Australian case concerning the PPSA which saw a large number of businesses lose their rights to personal property held by a corporate group when it entered administration (see Hastie Case Note below).
